Hi, I'm Paul McConnell from the Doctor Lawyer team. I'm going to talk to you for a minute about when to file a lawsuit in a personal life personal injury action. And then what happens after you file a lawsuit first with respect to when, in some cases, we file a lawsuit early on a personal injury actions if the other side in an automobile accident cases represented by either state farm or liberty, for example, very early on in the process, we decided to file a lawsuit and we will discuss that with you the reasoning behind that. In other cases, we firstly our clients go through their medical treatment with seeing the providers whether that's a physical therapist, for example, or a chiropractor. And once they've completed their treatment, which could take three months, six months, nine months, then we submit a claim to the insurance company. And oftentimes we settle cases that way. But sometimes we're not pleased with what the settlement offer is or clients and us and or they deny the claim altogether, which case, we file a lawsuit.

There's five phases to lawsuit, one pleadings to discovery, three pre trial proceedings for the trial itself, and five, in some cases, the appeals process. And each of these phases will take some time, the pleadings phase is short, that basically we initiate the lawsuit with a complaint with the allegations of what happened and what we're seeking in terms of damages. The other side, the insurance company, their attorneys will file an answer. That's the pleadings phase. And then shortly thereafter, is the discovery phase, we initiate discovery, and that is an exchange of documents back and forth. But it will assuredly include you for being deposed by the attorney for the other side. And the fear of the unknown. By making your deposition, you might have some fear, but rest assured, we're going to fully prepare you and we'll be with you. Oftentimes, they occur in a Catholic church, such as the one I'm sitting in now. And it'll be you with your attorney, and the insurance company's attorney and the court reporter. It's really just asking questions to get more back facts and background about what happened. And to be perfectly honest, it's often very helpful to educate the other side, this is what happened, this is what the case is. And that can be helpful to ultimately resolving your case.

During this whole process, all five phases, there's always the opportunity to settle the case. And frankly, more often than that cases do settle. But sometimes they don't. And after the discovery phase, there's the pre trial proceedings phase, which can include a Private Mediation or mediation of some sort, and orange, judicial pretrial. And then thereafter, there's the trial itself, just like you see on TV, pick a jury, there's a jury, a judge in a courtroom, you call witnesses and the other side calls witnesses and you examine them and cross examine them prepare documents and make arguments to the judge and to the jury and the jury renders the verdict then decides the case. And then in some cases thereafter, there's an appeals process. Not in every case, but in some cases, there'll be an appeal.
