Hi, I'm Paul McConnell, from the Doctor Lawyer team. And I want to talk to you for a few minutes about wrongful death claims. We just settled a case today on a wrongful death case and occurred to me I had a few thoughts that I thought might be worthwhile sharing. Not all wrongful death claims are created the same, obviously, they depend on the facts and circumstances is it somebody that's in their 40s, or in their 20s in the prime of their life, and they lost their life in a tragic car accident. Where the person the tortfeasor, the person who caused the accident really, literally took their life from them. In cases like that, how much insurance is on the table, and now we're going to dot every I and cross every T to see that not only is the drivers insurance on the table, but do they have an umbrella policy, are they wealthy and protect, perhaps have other amounts of money that might be available? Were they driving on behalf of somebody else in the like.
In the case we settled today, it was a medical malpractice case. And it had to do with wrongful diagnosis. And in this particular case, the person had been diagnosed with cancer and the cancer wasn't caused by the tortfeasor. In this case, the case was against the US government under the Federal Tort Claims Act. So there's no issue about how much money was on the table. But the US government those that acting on behalf of the government, the doctors at the VA hospital, they didn't cause the cancer but they didn't diagnose it in time. So that robbed this particular person as well as their loved ones have more time if they had gotten done what they were supposed to be doing. But other medical malpractice cases like MEC through the OMA there's causation where the in that case, the manufacturers of asbestosis products, you know, they literally they knew about the dangerousness of their products, they still sold them and put them out there and they literally cause the cancer. So that's a big difference as well.
You know, in all these cases, though, how do you value a life? I think of my loved ones, and you can think of yours, what would we give to spend another day, another week, a month, a lifetime with them? It's impossible, really to put $1 figure out, but this is the justice system, and that's what we get paid to do. Try to find some sort of justice for our clients. That is finding out what happened exactly who the who it is that's at fault, who caused this harm, and then provide as much compensation as we can to help try to make it right. Their gut wrenching cases. They're important cases, and we're grateful for anybody that trusts us to help them get the best that they possibly can and to make a right as a wrong as right as it possibly can be. God bless.
